1. Scope

These Terms & Conditions apply to all purchases of digital products from Looma Rae Digital Business Studio, owner Carmen Muteba, Peter-Henlein-Str. 73, 90459 Nürnberg, Germany ("we", "us"), through coachandbusiness.loomarae.com and our Payhip shop. Our products are made for coaches and small businesses. Different terms of the customer do not apply.

2. Products

We sell digital products such as templates, Canva template files (PPTX), fillable PDFs, Excel files, website templates, guides and bundles. The product description on the product page shows exactly what is included. Software needed to use the files (for example Canva, a PDF reader, Excel or Google Sheets) is not part of the product.

3. Contract

The product pages are not a binding offer but an invitation to order. By clicking the order button you make a binding offer to buy. The contract is concluded when we confirm your order by email or provide the download, whichever happens first. The contract language is English.

4. Prices and payment

All prices are final prices. As a small business according to § 19 UStG, we do not charge VAT. You can pay with the payment methods shown at checkout. Payment is due immediately when you order.

5. Delivery

After your payment you receive the download link on the confirmation page and/or by email. Please download and save your files promptly; download links may expire. If you have trouble downloading, email us and we will help.

6. Right of withdrawal for EU consumers

If you are a consumer (a person buying mainly for private purposes) in the EU, you have a right of withdrawal. For our digital products, this right ends early:

Your right of withdrawal expires as soon as we start the delivery (download or access), because at checkout you:

1. expressly agree that we start delivering the digital content before the end of the withdrawal period, and

2. confirm that you know you lose your right of withdrawal once delivery has started (§ 356 (5) BGB).

We confirm this consent in your order confirmation email. If you buy as a business (for example for your coaching business), there is no statutory right of withdrawal.

7. Licence (how you may use the products)

With your purchase you receive a simple, non-exclusive, non-transferable licence to use the products for your own business, including with your own clients. You may edit and brand the templates and use them for your own coaching business or small business.

You may not:

- resell, share, give away or upload the files (edited or unedited) as templates or digital products

- offer the templates in your own shop, a membership or a course

- pass the files on to other coaches or businesses

- claim the design as your own work

The full terms are in the licence document included in each product. All rights not granted remain with us.

8. Faulty or wrong files

If you receive a wrong, damaged or incomplete file, email us at mutebacarmen@gmail.com. We will send you the correct or corrected files. Our Refund Policy applies. Your statutory rights for defective digital products remain unaffected.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage. Our templates are tools, not legal, tax or financial advice. Contract and policy templates must be checked and adapted to your own business and country; we do not guarantee any business results.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not take away the protection of the mandatory laws of the country where you live. If you are a business, the place of jurisdiction is Nürnberg, Germany. If any provision of these terms is invalid, the rest remain valid.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
